Variance Hearing for Appeal Number  10253
7670 Hallenbeck Hwy, Manitou Beach, Mi. 49253

The Rollin Township Board of Appeals was called to order by Chairman Arlen Miller at 7:02 p.m. to hear an appeal for Nancy King for property at 7670 Hallenbeck Hwy to  replace a 6’ wooden fence with a vinyl fence.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Bob Mason, Jerry Wilson, Arlen Miller, Walter Miller. Absent with notice: Martin Staib, Richard Sherlitz.

Nancy King said that she had talked with her neighbors and they had no problem with the fence. The fence also helps screen out the noise from her air conditioner to her neighbors.

The board members found no problem with the fence. The fence looked good, did not obscure the view of the lake and it was in harmony with the neighborhood.

Bob Mason made a motion to accept the appeal as presented. Motion supported by Walter Miller.

Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After being read, he then asked for them to become a permanent part of the record. So moved by Chairman Miller.

A Roll Call vote was taken: Bob Mason: Yes, Jerry Wilson: Yes, Arlen Miller: Yes, Walter Miller: Yes. Motion passed.

Chairman Miller then proceeded to move on to the second appeal.

Variance Hearing for Appeal Number  10256
Elm & Main St.; Manitou Beach, Mi. 49253

The Rollin Township Appeals Board met to hear Appeal Number 10256 for Scott Eicher for property at Elm & Main Street to build a garage for storage. That exceeded allowed dimensions.

John Sineveck, the builder for Scott Eicher, explained the situation. Scott Eicher also spoke about the reason for the garage. Richard Edward, a neighbor also spoke in favor of the garage. There were many neighbors in attendance in favor of the garage.

Board members had several questions and they were answered  either by Scott Eicher, John Sineveck, or others on attendance.

There was a lengthy discussion among the board members . After a considerable period of discussion Chairman Miller closed the discussion.

Walter Miller made a motion to reject the appeal as presented. Motion supported by Jerry Wilson. A Roll Call vote was taken: Bob Mason: No, Jerry Wilson: Yes, Arlen Miller: Yes, Walter Miller: Yes. Motion passed.

The Board then proceeded to discuss ways to make a compromise. After a much discussion no way was found to make a compromise. Jerry Wilson made a motion to close the hearing. Motion supported by Bob Mason. All ayes voted. The hearing was closed.

Jerry Wilson  made a motion to approve the minutes of the July 27, 2009 minutes (Burger Appeal number 10243). Bob Mason supported the motion. All ayes voted.

Jerry Wilson made a motion to adjourn. Motion supported by Bob Mason. Meeting adjourned at 8:35 p.m.

Variance Hearing for Appeal Number  10243
2675 Round Lake Hwy, Manitou Beach, Mi. 49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for Dennis Burger for property at 2675 Round Lake Hwy to remove and replace a nonconforming fence.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Bob Mason, Jerry Wilson, Arlen Miller, Martin Staib, Walter Miller.

Dennis Burger explained  that his neighbors would be residing the area next to the fence and also the fence would have to come down because of a dying tree disrupting the fence.

The board discussed the situation and found no problems and that the fence would be in harmony with the neighborhood.

Jerry Wilson made a motion to approve 50’ of new fence (same material) on the property line not to exceed 6’ height. Martin Staib supported the motion.

Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After being read, he then asked for them to become a permanent part of the record. So moved by Chairman Miller.

Roll Call vote was taken: Bob Mason: Yes, Jerry Wilson: Yes, Arlen Miller: Yes, Martin Staib: Yes, Walter Miller: Yes. Motion passed.

Martin Staib made a motion to approve the June 29 minutes. ( Babiak Appeal number 10226) Bob Mason supported the motion. All ayes voted.

 Variance Hearing for Appeal Number 10226
7870 E. Ferndale, Manitou Beach, Mi. 49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for  Edmund Babiak for property at 7870 E. Ferndale for a privacy fence already in place.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Bob Mason, Jerry Wilson, Arlen Miller, Martin Staib, Walter Miller.

Mr. & Mrs. Babiak stated that the privacy fence was so Mr. Babiak’s cigar smoke would not go over to the neighbors picnic table, which was just across the property line, and so the neighbors would not feel they would have to invite the Babisks over to eat every time the ate outside. Neighbors on either side of the Babiaks have no problem with the fence and  gave the board letters stating so.

The board discussed the situation and found no problems with the fence. No view was obstructed by the fence and no neighbors were there to complain.

Jerry Wilson made a motion to approve the privacy fence with the condition that the fence will need a permit and go to 4’ height and 50% open if it is ever increased from the 11’9” in length it is now or altered in any way. Martin Staib supported the motion.

Jerry Wilson  then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After being read, he then asked for them to become a permanent part of the record. So moved by Chairman Miller.

Variance Hearing for Appeal Number  10223
11320 W. Ferndale, Manitou Beach, Mi. 49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:05 p.m. to hear an appeal for Marilyn Porzondeh for property at  11320 W. Ferndale for a storage shed.already in place.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Richard Sherlitz, Jerry Wilson, Arlen Miller, Martin Staib, Walter Miller. Absent: Bob Mason.

Marilyn stated that the purpose for the shed was to have a place to store a lawn mower and the gas for it.

Board members discussed the situation.  There are no other buildings on the property besides the house. There was a need for a storage shed. Fire code was discussed.

Jerry Wilson made a motion to leave the shed where it is at and have Marilyn talk to the building inspector to see what kind of fire wall has to be put up and if any other building is built (garage) that the shed must be removed. Richard Sherlitz  supported the motion.

Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After being read, he then asked for them to become a permanent part of the records. So moved by Chairman Miller.

June 22, 2009 Second Appeal. Appeal number 10228  for Christopher Sherman, 9042 Cherry Point , to replace an existing be-level deck with a new one level deck.

Chris Sherman explained what he wanted to do, to replace the ramp deck and level it with a one level deck.

There was much discussion between the board members and Chris, and the representative from Merit Builders. After much discussion a compromise was reached.

Jerry Wilson made a motion to allow  a maximum of a 20 x 20 foot square deck 48” off the water side of the breakwall. Height of the deck to be approximately 63” above the breakwall. The steps are to be approximately the same as they are now. Martin Staib supported the motion.

Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After being read he then asked for them to become a permanent part of the record. So moved by Chairman Miller.

Variance Hearing for Appeal Number 10188
8682 Cherry Point, Manitou Beach, Mi. 49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for Joe Crossgrove for property at 8682 Cherry Point for a privacy fence.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Richard Sherlitz, Jerry Wilson, Arlen Miller, Martin Staib, Walter Miller.  Absent with notice: Bob Mason.

Fence has already been installed. Michigan Build Specialties rep. Was on hand and explained what had taken place. He said they were willing to go through the proper channels to make the situation right.

A neighbor, Paul Gallagher, said he had problems with the fence. 1. Said it devalued his property. 2. Talked about the tornado and he couldn’t see what was going on on the South side of the lake. 3. Claims the fence will push snow on the road. Jerry Wilson pointed out that the road was private, not Township. Paul wants the fence out.

Pat Barchiek-Schissler wanted to know what the purpose of the privacy fence was. Mrs. Crossgrove explained it was to hide from view their wood pile. Pat said last year another person came before the board and the board turned down their request. Jerry Wilson said the request was turned down because the fence was not on that person’s property.

Bob Phelps said that Paul Gallagher has had a complaint with almost all the neighbors over the years. Karen Phelps said the fence looks good.

Jerry Wilson asked how high the fence was. Joe Crossgrove said it was 61/2 feet and stepped down to 51/2 feet.

Various board members commented that they like the fence but it should be in line with the ordinances. Jerry Wilson made a motion to deny the application as applied for. Martin Staib supported. All ayes voted.

Jerry Wilson made a motion to take the fence from the ground to a 4’ height and leave the bottom open as it is now. Martin Staib supported. Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After being read , he then asked for them to become a permanent part of the record. So moved by Chairman Miller.

A roll call vote was taken: Richard Sherlitz: Yes; Jerry Wilson: Yes; Arlen Miller: No; Martin Staib: Yes; Walter Miller: Yes. Motion passed. Approval reason for the record is that the fence is in basic harmony with the neighborhood and will cause no harm.

Jerry Wilson made a motion to approve the minutes of the May 18 meeting. (Valentine, Appeal number 10208) . Martin Staib supported the motion. All ayes voted.

Variance Hearing for Appeal Number 10208
2705 Round Lake Hwy, Manitou Beach, MI  49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for Jack and Deborah Valentine for the property located at 2705 Round Lake Hwy. to all 2nd story addition to cantilever over existing 1st floor.

Chairman Miller stated the prupose of the meeting and introduced the board. Board members present:  Bob Mason, Jerry Wilson, Arlen Miller, Martin Staib and Richard Sherlitz. Absent with notice:  Walter Miller.

Jack Valentine was asked various questions as to final overhang dimensions from various board members.

Jerry Wilson made a motion to accept blue print as presented, except to eliminate encroachment on the south side of the home. Allow 2 foot cantilever on road side and lake side with the 2nd story ceck on the lake side. Any changes, the appeal will become null and void. Martin Staib supported the motion.

Jerry Wilson then proceeded to go over section 22:06 of the Rollin Township Ordinance Standards. After being read, he then asked for them to become a permanent part of the record. So moved by Chairman Miller.

A roll call vote was taken. :  Bob Mason: Yes, Jerry Wilson: Yes, Arlen Miller: Yes, Martin Staib: Yes and Richard Sherlitz: Yes. Motion passed.

Variance Hearing for  Appeal Number  10195
10040 Devils Lake Hwy., Manitou Beach, Mi. 49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for Gary & Lynne Hicks for property at 10040 Devils Lake Hwy. To build a deck with less than required setback.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Bob Mason, Richard Sherlitz, Arlen Miller, Martin Staib, and Walter Miller. Absent with notice: Jerry Wilson.

Gary & Lynne Hicks explained what they wanted to do and explained that there was a deck there before. Builder Bob Brown had pictures of the deck that had been there before.

Board members had several questions regarding the proposed deck and Brown and Hicks answered the questions.

Chairman Miller read a letter of abjection to the deck from  Marilyn & J. Robert Jesionowski. Chairman Miller then stated that we do not look at the lake as a whole when making decisions but only the properties close by.

Martin Staib made a motion to accept the blue print as presented as long as the railing height does not exceed the neighbors to the North deck height. Bob Mason supported the motion.

Martin Staib then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After they were read he asked that they be made a permanent part of the record. So moved by Chairman Miller.

A roll cal vote was taken. Bob Mason: Yes; Richard Sherlitz: Yes; Arlen Miller: No, Martin Staib: Yes; Walter Miller: Yes. Motion passed.

Approval reason for the record is that the deck is in basic harmony with the neighborhood and will cause no harm.

Variance Hearing for Appeal Number10197
3021 Round Lake Hwy., Manitou Beach, Mi. 49253

This appeal is for Dr. Paul Gietzen to construct a l8’ x 8’ porch which will encroach set back. Claude Rowley was there to represent Dr. Gietzen. Neighbors to the North, John & Connie Seiser were also there to lend support for the proposal.

Claude Rowley explained what they wanted to do and the neighbors were in favor of the proposal. The board had a few questions which Mr. Rowley answered.

Bob Mason made a motion to approve the request as presented. Walter Miller supported the motion.

Martin Staib then proceeded to go over Section 22:06 of the Rollin Township Ordinance Standards. After they were read he asked that they be made a permanent part of the record. So moved by Chairman Miller.

The issue of a shed in the back yard with less than required set back  was then addressed.
Martin Staib made a motion to have the owner move the shed to meet requirements of 3’ from the North East neighbors property line and 3’ from the back property line. Walt Miller supported.

3225 Round Lake Hwy. Manitou Beach, Mi 49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for Mike & Nancy Haldy for property at 3225 Round Lake Hwy. For demolition and rebuilding a home.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Bob Mason, Jerry Wilson, Arlen Miller, Martin Staib, and Walter Miller.

Rodney Wilt said that the foot print has changed. Instead of an enclosed porch there will be a patio. This changes the square footage from 1456 to 1155 square foot. This square footage now falls within the regulation limit of 30% lot coverage for the building.

This change  of the foot print was looked on with favor by the board members. After discussion Jerry Wilson  made the motion to grant  the request with a 5’ setback on the south side of the lot, 4’ on the North side, and 25’8” from the lakeside property line. Motion seconded by Walter Miller.

Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance standards. After they were read he asked that they be made a permanent part of the record. So moved by Chairman Miller.

2600 Geneva Highway, Manitou Beach, Mi. 49253

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for Robert Perry for property at 2600 Geneva Hwy. For demolition and replacing a home.

Chairman Miller stated the purpose of the meeting and introduced the board. Board members present: Alternate member Tim Miller, Jerry Wilson, Arlen Miller, Martin Staib, and Walter Miller.  Absent with notice: Bob Mason.

Mickey Miller, the builder for the owner, explained what they wanted to do.

After discussion of lot coverage, setbacks, and foot print, Jerry Wilson made a motion to deny the request as presented. Martin Staib supported the motion. All ayes voted.

After discussion Martin Staib made the motion  to approve a house 34’ x 24’ with a 8’ x 24’ deck on the lake side of the house. House is to be 3’ from the Westside of property line, 6’ from Geneva Hwy, and 7’ from the Southeast side. Motion supported by Jerry Wilson.

Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance standards. After they were read he asked that they be made a permanent part of the record. So moved by Chairman Miller.

The Rollin Township Appeals Board was called to order by Chairman Arlen Miller at 7:00 p.m. to hear an appeal for David and Cheryl Rajner for property at 2139 Yacht Club Drive for  setback requirements.

Chairman Miller stated the purpose of the meeting  and introduced the board. Board members present: Bob Mason, Jerry Wilson, Arlen Miller, Martin Staib, and Walter Miller.

David Rajner explained he wanted to demolish the present house and what he wanted to build in its place.

After much discussion between the board members and David Rajner Jerry Wilson made the motion to deny the appeal as presented. Second by Martin Staib.  All members voted ayes.

Jerry Wilson made the motion to allow the front of the house to be 17 feet from Yacht Club Drive, 17 feet from the deck on the back of the house to Marsh Drive, and to have at least 10 feet side setbacks. The house is to be 28 feet by 52 feet and to allow an 8 foot by 52 foot deck on the Marsh Drive back side. Motion supported by Bob Mason.

Jerry Wilson then proceeded to go over Section 22:06 of the Rollin Township Ordinance standards. After they were read he asked that they be made a permanent part of the record. So moved by Chairman Miller.

Chairman stated the purpose of the meeting and introduced the board. Board members present: Arlen Miller, Roscoe (Jerry) Wilson, Bob Mason, Martin Staib, and Walter Miller.

Robert Marquis explained the situation and said he did not realize he needed a permit for the Rubber Maid shed. He stated that the shed had been in the same location since 2004 and on the property since 2002.

Dan Hupp stated he would like to add 8’ of living space and an 8’ deck in front of his current home.

Jerry Wilson then made the motion to allow an 8’ addition to the home and to expand the present deck 2’ beyond the new addition as long as the new deck is 10’ from the East property line. The Rollin Township Appeals Board meeting was called to order by Chairman Arlen Miller at 7:00 pm.to hear an appeal for Jeff Tagsold for property at 11570 Round Lake Drive, for lake setback requirements.

Barry Garrow of Michigan Building Specialties explained the proposed building and said the shadow line of the roof to the lake would be 24 feet and from the foundation to the lake would be 26 feet.
